General Information regarding the EU Directive 2002/58/EC

Each affiliate who wishes to partake in Email Marketing with any Tradedoubler client must comply with the EU Directive 2002/58/EC. A copy of the directive in PDF format can be found here

By agreeing to the terms and conditions of the Affiliate Agreement, you confirm your compliance with these regulations. Below follows a brief summary of the relevant directive. However, please note that this summary is for your convenience only and it is very important that you read the complete directive and secure that your business complies with the directive in full.

  1. You must have a link to your privacy policy on every email that you broadcast. You must have this privacy policy live on your site at all times and a statement of cookie presence and what that means to the user. This policy will also tell users what personal details you take, and how you deal with those details. You must not share these details with anyone without users prior knowledge and explicit permission.

  2. All users on your database must have opted in to receive correspondence from you and you must also have confirmation of agreement from these users to receive third party offers. You cannot email your users any offers taken from the Tradedoubler platform without this consent.

  3. Furthermore, you must be able to prove users' status should they question their subscription - this is typically done by way of a time-stamp showing opt-in email address. Ideally you should ensure you operate a double opt-in policy as this shows unequivocal status.

  4. Unsubscribe: You must have a link on your email for the user to unsubscribe. You must inform the user exactly how to do this, and the click through of the link must go to a functioning url/email where unsubscribe can be completed. You should have an additional support email address for the user in case there is any problem with the unsubscribe function.

  5. You must initiate the unsubscribe within a reasonable time-frame, and you must inform your user of such time frame (typically from 24 hours to 7 days)

  6. You must inform the user that they may receive another newsletter before you have time to delete their email address from your database.

  7. It is very important that you clean you list (manage unsubscribes/change of email addresses, etc) on a regular basis.

  8. If you send a third party mail you must have a header or footer informing the user that they are receiving this email from you as a third party offer (i.e. you must make it very apparent the mail is coming from you, and not from the client whose offer you are promoting)
